Legislation is usually a lagging indicator, governments codify what has already become politically inevitable. Kenya's Climate Change Act, signed into law in 2016, was closer to a leading one. It gave the country one of the earliest dedicated statutory climate frameworks in Africa, ahead of many peer economies that were still managing climate policy through non-binding strategies or ministerial guidelines with no real legal teeth behind them.

What the Act Actually Established

The Act created a National Climate Change Council chaired at the highest levels of government, established a Climate Change Fund to help finance mitigation and adaptation activity, and required climate considerations to be mainstreamed into national and county development planning, rather than treated as a standalone policy silo that other ministries could safely ignore. That mainstreaming requirement is the part that matters most in practice, it means climate considerations show up in planning documents across government, not just in the documents produced by whichever ministry happens to own the climate brief that year.

A strategy can be abandoned by the next administration with a single memo. A statutory framework, with its own council and its own fund, is considerably harder to simply walk away from.

Why This Actually Matters to a Twenty-Year Financing Decision

For project sponsors and lenders, a dedicated legislative framework of this kind sends a specific signal: that climate policy risk in the jurisdiction is more likely to evolve in a direction that supports long-dated clean energy investment than to reverse it. That distinction matters more than it might initially seem. Investors underwriting twenty-year power purchase agreements are pricing in political and regulatory risk over a horizon that will outlast several administrations, and an early, institutionalised legislative commitment measurably reduces the perceived risk that climate-related policy support could simply be withdrawn by whoever holds office a decade from now.
